WHAT
IS COMPUTER LAW?
A PARABLE:
It
was late summer 1987. It was a relief to get out into the
night air after three hours of listening to the fine points
of tax, while sitting in in a room that was ten degrees
too hot. We walked to the subway with an elderly attorney.
We told him we worked in the area of computer law. In a
professorial tone, he told us to tell him the difference
between intellectual property and computer law. We tried
to find an answer for him by saying that computer law had
to do with computers; intellectual property, on the other
hand, overlapped but did not cover all possible computer
issues. He scoffed and asked us to point out an area where
"computer law" did not have something to do with property
of the mind (intellectual property). We could not fathom
a reasonable answer.

| For
many years, we have held to that attorney's opinion
that computer law actually was only a subset of intellectual
property. As technology has exploded in this Information
Age, we now know that computer law is truly an area
of practice overlapping, but none-the-less separate,
from intellectual property. It also can be argued that
there is another separate area of law dealing with telecommunications.
In our opinion, the intersection of computer and telecommunications
law is even greater than that of intellectual property
and computer law.
We
